1. Who we are
Kert-Ed LLC, (“Company,” “we,” “us,” “our”) is a company registered in Hungary under company number 06-09-008002 with its registered office at 6772 Deszk, Tó köz 2., Hungary. EU VAT No.: HU-12857830.
These Terms & Conditions (“Terms”) govern your access to and use of the website thesecondact.club and any products, services, courses, memberships, downloads, and content.

By accessing or using the site, purchasing a product, or joining a membership, you agree to these Terms.
2. Eligibility & accounts
You must be at least 18 years old to purchase. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
3. Products, pricing & orders
3.1 Digital products & courses. We sell digital downloads and online programs (e.g., workbooks, templates, courses hosted in LearnDash).
3.2 Pricing. Prices may change without notice. Applicable taxes (e.g., EU VAT) are calculated at checkout based on your billing details.
3.3 Order acceptance. We may refuse or cancel an order if fraud is suspected or for operational reasons.
3.4 Currency & payments. Payments are processed via third-party processors (Stripe/PayPal). You authorize the processor to charge your selected payment method.
4. Delivery & access
4.1 Instant access. After successful payment, you receive account access to your purchased materials (typically via “My Account” and/or LearnDash).
4.2 “Lifetime access.” If stated, “lifetime” refers to the lifetime of the product/platform as operated by us. We may update, replace, or retire products for security, legal, or business reasons, but we aim to provide reasonable notice.
5. License & permitted use
Unless otherwise stated, purchases grant a personal, non-exclusive, non-transferable license for your own business or personal use. You may not resell, redistribute, sublicense, share login credentials, or publicly post the materials.
6. Intellectual property
All content (text, designs, graphics, videos, audio, code) is owned by or licensed to us and protected by IP laws. All rights not expressly granted are reserved.
7. Refunds & right of withdrawal
7.1 You have 14 days from your purchase to request a refund. Refunds are considered if you have not yet downloaded the product or if there is a proven technical issue preventing access. Once a product has been successfully downloaded or accessed, we generally cannot issue a refund, as digital files cannot be “returned.”
7.2 EU consumers. If you are an EU consumer, by purchasing and accessing digital content immediately, you acknowledge and expressly agree that your 14-day right of withdrawal does not apply once delivery has begun.
7.3 Memberships. Membership fees are non-refundable for the current billing period after renewal. You may cancel future renewals at any time (see Section 8).
8. Memberships & subscriptions
8.1 Monthly Membership. If offered, membership renews automatically each billing cycle ($9.99/month on sale, after that $14.99) until cancelled.
8.2 Cancellation. Cancel any time via My Account → Subscriptions (or email us admin@thesecondact.club). Cancellations take effect at the end of the current billing period.
8.3 Changes. We may modify membership features or price upon notice. Continued use after the effective date constitutes acceptance of changes.
9. Promotions, coupons & trials
Promotional offers, coupons, and trials are subject to their specific terms and may be withdrawn at any time. Unless stated, promotions cannot be combined.
10. Third-party tools & links
We may use third-party tools and link to external sites. We are not responsible for their content, availability, or practices. Your use is governed by their terms and policies.
11. No professional advice
Site content is for educational and informational purposes only and does not constitute financial, legal, medical, or therapeutic advice. Always consult a qualified professional for your situation.
12. Disclaimers; limitation of liability
13.1 “As is.” The site and content are provided “as is” without warranties of any kind. We do not guarantee specific results or uninterrupted availability.
13.2 Limitation. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or products. Our aggregate liability shall not exceed the amount you paid in the 3 months preceding the claim.
13. Indemnification
You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the site.
14. Termination
We may suspend or terminate your access for any violation of these Terms or unlawful activity. Upon termination, your license ends, but sections intended to survive (e.g., IP, disclaimers, liability limits) remain in effect.
15. Governing law & disputes
Governing Law & Jurisdiction. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of Hungary, without regard to conflict-of-law rules. The courts of Szeged, Hungary shall have exclusive jurisdiction to settle any such dispute or claim.
If you are a consumer resident in the EU/EEA/UK, your mandatory consumer rights under applicable law are not affected, and you may bring proceedings in your country of residence where required by law. You may also use the EU Online Dispute Resolution platform.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated (e.g., site notice or email). Your continued use after changes become effective constitutes acceptance.
